The callback form that gives you the right to call

Since 11 August 2026, a consumer in France can only be called with a commercial offer if they agreed beforehand, and you must be able to prove it. Your website form therefore becomes the entry point of all your phone prospecting. Here is how to build it so the consent is valid and the proof solid, based on the guidance published by the DGCCRF. This guide is information, not legal advice.

What the rule requires

Consent must be free, specific, informed, unambiguous and revocable, and given by a clear positive act. It is valid for one year at most.

The proof must be verifiable and traceable, kept for at least three years, and handed to the person on request.

Each word in that list becomes a concrete choice in your form.

A separate box, never pre-ticked

Unambiguous and positive act: the person ticks a dedicated box themselves. A pre-ticked box, consent buried in the terms, or simply submitting the form is not enough.

Free: sending a quote request must not depend on agreeing to be canvassed later. Keep the request and the consent separate.

Wording that says who calls, why, and how

Specific and informed: the text next to the box names your company, the purpose of the calls and the means used. If an automated voice assistant may call, say so: the person then knows what they are agreeing to.

Example wording to adapt with your adviser: "I agree to be called back by [your company], including by an automated voice assistant, about my request and its [field] offers. I can withdraw my consent at any time."

What to record with each submission

Date and time, the number and name entered, the page and source of the request, and the exact text shown next to the box at submission. If you change that text, keep the versions: the proof must show what the person read.

Store these records where they will stay for at least three years, and where you can find them quickly if the person or an inspector asks.

One year, then ask again

Consent expires after one year at most. Record each contact's expiry date and remove them from campaigns when it passes, unless they gave new consent or now have an ongoing contract with you that justifies the call.

Withdrawing must be as easy as agreeing

Revocable: the person must be able to say stop easily, by phone or in writing. When they refuse during a call, stop immediately and remove them from every campaign, not just the current one.

Then: call back fast

A good form gives you the right to call. It does not give you the sale: a request goes cold within minutes. Calling back within the minute, during permitted hours (Monday to Friday, 10 am-1 pm and 2 pm-8 pm, excluding public holidays, unless a specific appointment was agreed), and without exceeding four calls in thirty days, is where the result is decided.

FAQ

Questions we get asked

Does a quote form count as consent to be canvassed?

Not on its own. Calling the person back about their request is expected; canvassing them afterwards for other offers requires separate consent, given with its own box.

Do I need new consent from old contacts?

To canvass consumers, yes, if there is no proof of valid consent less than a year old, unless an ongoing contract relates to the purpose of the call.

How long should I keep the proof?

At least three years, and it must be available to the person on request.

Should I say a bot may call?

For consent to be informed, we recommend saying so in the checkbox text. The agent must in any case introduce itself as an automated assistant at the start of the call.
